    Dead Teen Sued for Losing Control of Flying Body Parts

    You think you've heard it all until I tell you that an appeals court in Illinois recently ruled that a woman is allowed to sue a dead teen's estate for injuries caused by his flying body parts. The 18-year-old boy was running across the Amtrak tracks to catch another train but didn't make it -- he was hit by an oncoming train going 70 mph and his body was torn apart by the force and flung onto a nearby passengers' waiting platform. The woman, 58, was struck by a sizable chunk of the boy's body and was knocked to the ground, breaking her leg and wrist. The court ruled that the boy's death was "reasonably foreseeable" and that his estate can be held responsible for his negligence.
    I'm sorry, but who goes around suing a dead teen whose body was ripped to shreds in one of the most gruesome ways imaginable?
    I can't say that my first or even fiftieth instinct after being pummeled to the ground by half of a bloody torso would be to raise my fist in the air and declare that whoever had the nerve to let their body explode and land on me will most certainly pay in court. Even if my leg was shattered, I still can't imagine going after the dead teen's estate.
    The family of the deceased has suffered enough -- their son was blasted by a train. It doesn't get much worse than that. And to think that they have to endure a woman nitpicking her way into their bank accounts is disgusting. It's not like this kid had millions -- what is she hoping to gain from this lawsuit?
    It won't make her leg any better. I can't imagine it'd help her heal in any way, shape, or form. I don't think a normal person would feel good about suing for injuries caused by a dead teen's flying body parts. Yeah, he did something incredibly stupid, but I think he paid the price. He's dead. His body was blown to bits. No need to drive the point home with what seems like a frivolous, greedy, and hurtful lawsuit.
    If you were in the injured woman's shoes, would you sue, too?

    I know someone who was sued after she walked in to traffic without looking and was hit by a car. The driver sued her to pay for the damage she did to his car through her negligent behavior. This case really isn't much different. I haven't read the article so I don't know the full story or how much she wants but if she has high medical bills or loss of income because of this kid's negligence then she has every right to sue for compensation on that front.     Maybe she cant afford healthcare like so many of us can't. Fixing a broken leg and wrist is very costly and if she works so is missing a few days, and this accident was through no fault of her own. As long as she isnt trying to make additional money off this family, I can see why she wants compensated and think she should be.

    yep agree with kristie and rhonda... but what're the chances that she isnt trying to sue for "pain and suffering' as well...? I can see the medical bills as well as her time compensation if she missed work but that is all.

    THAT SHOULD BE "AGREE". To add on, I thought that maybe this was something outragous, but she deserves for her medical bills to be paid for and some punitive damages. he was negligent, and yes it is terrible how he died, but it was not her fault that she broke her ankle. Imagine how she feels, when she is sitting there minding her own business and this torso flies out of nowhere, causing her bodily harm?? How do you think her mental state is from that??

    Personally I would be unlikely to sue because I can afford my medical bills, I have insurance, and it is tragic.
    But... Casts cost money, having metal plate or rods inserted cost more. Physical therapy more still. Worse, for people in poor medical condition a simple break can have major complications. I know of a woman under the age of 40, who spent months in a comma, then died, all from what started as a broken leg.

    If the woman can't afford the care she needs, then yes, yes, the money could heal her.

    It was probably an ambulance chasing lawyer doing the dirty work.
    I know I would be traumatized by such an incident.

    Only a liberal democrat would file this kind of lawsuit and only another liberal democrat would agree that the lawsuit is justified.

    Only a con would think that rich people deserve the exclusive privilage of health coverage, and if someone standing waiting for a train suddenly out of nowhere gets injured through freak circumstances they should go into bankrupcy because of it.

    Medical care is like anything else. If you want better care and better service, you better be prepared to PAY for it.

    If that means doing without the extra color TV, annual vacation and having to take the bus to work instead of owning your own car, then so be it.

    Free, unlimited medical care is NOT a right and NEVER should be.

    Turd, here's hoping you are on the wrong end of one of these frivolous lawsuits.
