What I'm saying is get a lawyer immediately and do what he or she tells you. This will almost certainly involve pleading not guilty, but you'll want to have your lawyer with you when you do so.

In general, don't talk about this and don't act on this without your lawyer present.

Yeah the DA will try to use the prior even though it was expunged. Listen to Ganch. Get an attorney pronto. If you need to have one appointed, petition the Court immediately. And above all else, please, please, please, PLEASE remember you have the right to remain silent. It really is in your best interest to do so. Your attorney will know the options of the possibilities of drug court, rehab, perhaps 6 months to a year of drug screens by having the case placed on an Admin docket.

i got busted almost 15 years ago for an 8, they tried to throw the book at me, it was my first ever drug arrest, cops tried to claim it was rock, bullshit, it was just real good shit, it was just cut off a corner of an OZ block, shit had a slight yellow haze to it, wasn't that bullshit most people were getting that was all stepped on and shit, all loose powder and bright white mixed with vitamin b or baby laxative powder.
my bail was set at 2G, but i got out the next morning on my own recog. had arraignment, didn't even ask me if i could afford an attorney, just said here's your court date and get a lawyer. got a lawyer and then went through a little over 2 years of hell, cost me around 3-4 G over the course of it. started in district court downstairs, stupid lawyer tried to get me to take the plea bargain, they wanted to charge me with a felony and do 1 year and drug classes after i got out and be on probabtion, i told my crack head lawyer i ain't doing shit for a first offense, we had another date, they tried to give me 6 months and drug classes and 5 years probabtion, i said **** that, my lawyer tried to sell me on that shit, i think he must've been used to dealing with crackheads that think jail is a home away from home. we ended up taking it upstairs to circuit court, that shit got nutty , holdovers, more offers, holdovers, delays, one cop could make the date but the other couldn't, then the other could and the other couldn't, change in prosecutors, and other bullshit. finally after about 14 court dates in 2 years , the judge asked me one day if i was still working at the same job and i said yes, he said he was throwing it out cause i had been out on bail basically and if i would have been arrested for anything in that time frame i would of went to jail, so since i was still working at the same place and hadn't been arrested for anything and it was my first offense he was dismissing it.
the prosecutor and the one jughead cop were all pissed.
it was all worth it in the end i guess for fighting it, even though my lawyer was a moron, cause i ain't got no felony.

Please forgive my ignorance, I'm not a drug guy, although some aspects of my life do naturally parallel those of the crackhead - but isn't an "8-ball" not a lot? Isn't it like, let's say you want to party for a night, and maybe you have a friend or two who will be hanging around with you, you might score an 8-ball? Is that not accurate? Can you get seriously busted just for the amount it would take for a guy and a friend or two to party it up?

That's still so messed up. Intent to distribute an 8ball. I guess you would've needed a quarters worth to make them realize it was for your own use? Cops will always drum up charges as they see fit, but he may be in the clear here, there's a certain weight which they can file that under if I'm not mistaken.

I really didn't think it was as little as 3.5 grams, but I've never had a run in like that..

here are some tips...maybe you already know it.

1. i think your last charge was erased, so it might not show up. if that is the case, you're really lucky...no record means you can pretend to be a good boy and get some break from the prosecutor.

2. if your lawyer can get you off on an illegal search, then you're really lucky...but i doubt that could happen.

hopefully, you'll get a good lawyer...and trust me...good lawyers will cost you 10k min...maybe you can get off with 1-2 years probabtion...be a good boy for a while then you're off the hook.

in america, only poor people go to jail. if you ain't broke, there is nothing to worry about.

DO NOT GET A COURT APPOINTED LAWYER. THEY ARE TERRIBLE.

Pay your own bill and get a reasonable decent one lawyer, especially with your previous record. Your record is not good. Its not like you got caught with a dime bag of weed previously... Your military record should help.

Keep this last paragraph in mind.

It will cost them more money to take you to court and prosecute you to the fullest extent of the law. The DA wants to settle, your lawyer wants to settle, you want to settle. All it really comes down to is how well you/your attorney can negotiate and wheel and deal.
