2.5k retaining fee and some smooth talking southern lawyer got me a 3 month diversion so he can reach a plea or have this dismissed. Got guaranteed nothing more than 2 years probation.
Going to end up costing at least 6k though.
Good thing its not football season.

The authorities want to make you feel like a douche bag,
defense attorneys think the authorities are douche bags,
the whole process is a very interesting cat and mouse game.
I wish you the best BOT.

basically this is how I think drugs work.
1 day in jail x amount of dollars.
getting a lawyer to get you off or reduced x amount of dollars
eitherway your paying x amount of dollars it just depends on if you want to stay in jail or buy your way out.

Sorry to hear .
What state are you in ???
( some states like Nevada and Arizona there hard core about drugs) In States like Cali , NY ,FL, the charges get dropped or to smaller charge Felony to Misdeminor )
Was the coke all in one bag ? or seperated ? If separated thats not a good Thing . They will try to get you for sales ?
My friend got busted for a gram and was drunk in public . He
did a few days in Jail , Got the charges dropped to a fine and droped felony charges . He did have a lawyer and lives in Cali ( where almost the whole state would be in Jail if Weed was a Felony)
Another friend was in AZ and got busted for a roach ,They took him to jail and was charged with a felony and was sentenced to 1 year in Jail ( he did 6 months time )
Good luck

An 8 ball is 3.5 grams of coke. An 8th of an ounce, thats where it gets its name. Yes it is a small amount.
For him to get distribution he must have had it in more than one bag.

Sorry Bot....just got to a computer for the first time today. Sounds like you did alright. Stay with this guy if you like him. I am looking for info on Washington State to see how they treat first time offenders. Are you a first timer? If so, you should not have too many problems considering the answers you gave me earlier.
Here is another point. Did they find any pot in the car? Something your Lawyer can work on:
If you had no pot, and he found none in the car, how can he smell it? If he didn't smell it, how can the search be justified? May get thrown out. Play the system and drag it out like Louisville said in a previous post. The longer it goes, the better chance you have to get it thrown out.
Last, once you receive probation, keep your nose clean (no pun intended). The system is set up for you to fail. They want you to get into trouble again. It's all about the money.
Funny thing here....Cocaine from Clapton just came on Sirius while I am typing this s.....

This would at least be enough to allow him to pat you down, but not search the car unless you consent to it.
What you have here is a cop smelled or thought he smelled marijuana. It's a K-9 unit, so more than likely he's going to be very experienced and specially trained in the narcotic area. Whoever your new Lawyer will be, he will probably be challenging the credibility of this Officer, and that he didn't make up that smelled based on a mere hunch that allow him to do a search on you.

Frost is dead on here again.
Once you gave consent you were along for the ride. If you cooperated with them, tough for them to prove either way without audio, and just video. This will plea out and you will get the Probation you were told. Washington is middle of the road on coke. You shouldn't have a problem being a white kid with white powder. The judge will laugh at the distribution, that will get thrown out. Then the rest is the traffic stop, but with your consent I think you are along for the ride now.
You will probably have to do some classes....that cost cash too. So add that on to your Attorney fees.
GL and feel free to PM me if you want some more help.

We are in the beginning stages of summer in northern Minnesota after experiencing crappy weather for months on end.We should get beautiful weather through October. In the northeast part of the state it's all forest and lakes and tourist towns and you can camp for free in some national forest campgrounds. You can buy groceries and beer and pretend to be a fisherman-camper for months on end and by October the heat will be off and you can live in Vegas for the winter months.

only 2.5k. good deal. one of the lawyer strategy is trying to postone the court date as long as possible. after a year, the chance of the cop remember you is pretty slim.

there you go. the more respectable you're compared to the other people, the better. your lawyer will use the usual bullshit...he is a good boy...went to college...good citizen...blah blah blah
no worries, i think you'll get off with a 5-7k lawyer bill plus 300-500 court fee and a year of probation.

What a f*cking nightmare. I'd identify the best defense lawyer in town, take out a second mortgage and get cash into his hands ASAP. I'd say absolutely nothing to the cops or anyone else without a my high priced mouthpiece present at all times. I'd then follow Mouthpiece's instructions instructions to a T and have more money on hand to do as he says when he says to do it. No freakin way I'd go to prison. And then when I wasn't at court or work or sitting at home trying to prevent any further trouble, I'd be working on getting more money. It's worked for many white guys who have done far worse than you have.
Damn - update - just saw things are going well for you in latest posts.
Good luck bro. We're pulling for ya.

I bet that hot prosecutor is has lot of money considering that she's probably already sucking some married, family values, conservative, anti-gambling's politician's cock during recess or some family values reporter like Bill O'reilly.
How much time until we see her in a short skirt as a part of Fixed News, I mean Fox News political team?

yeah, if you didn't have pot in the car I would have never consented to the search. The whole thing with probable cause to search your car is a joke. All you have to say is I don't have to consent and I don't want that dog going through my car, and I want to speak to an attorney before anything else happens.
What you had the officer wouldn't have been able to smell so everything would have been thrown out from there. At least with a good attorney. Never ever consent. Yes they can threaten you with your drivers license but if you come up clean an they search anyways, they are in trouble. If they come up and find something they have to prove reasonable cause and tell you why in advance they have a warrant to search. You can ask to see the warrant as to why they have to search. If they don't match up, your lawyer will have a field day with them.
Never ever consent to searches... Its bad for your record, and ties a good attorney hands.

In Florida, police do not need consent to search the car IF the K-9 alerts on the car (therefore initiating Probable Cause).
If I'm not mistaken, this is nationwide and was passed within the last year or two by the Supreme Court.
With that said, the K-9 needs to arrive on the traffic stop within a reasonable amount of time after the traffic stop is initiated. (I believe it's around 16 minutes)
Also (as purecarrnage alluded to), they should have had you sign a Waiver of Search Warrant right there on scene. Because you didn't sign one, your lawyer can argue that you were unaware of your rights (the Waiver explains your right to NOT consent to the search and have the right to stop the search at any time).
Good luck BOT and in the future, don't carry narcotics in your vehicle or on your person. And if you do, keep it to under 20 grams of weed.
