Therefore it is better to err on the side of caution when recording an interstate telephone call.

5 star could, in illinois, file a criminal and civil complaint against JJ. While it would not hold water in JJ's state he could be arrested and dragged back to Illinois to stand trial. Good job JJ way to think things through.

I'm not sure that this law applies here.... but what do I know, i'm just a law student.

you need to use a case that has set a precident for this kind of case. The "crime" took place in NJ, if that is where JJ use the recording device. This case would be a mess, and you'd end up paying more than 50% of whatever you get to the lawyer. not even close to a slam dunk.
