An eavesdropping device is anything used to hear or record a conversation, whether the conversation is in person or conducted by any means other than face-to-face conversation, such as a telephone conversation. In addition, it is criminally punishable to disclose information one knows or should know was obtained through an eavesdropping device. Offenses of the eavesdropping law are punishable as felonies, with first offenses categorized as lesser felonies than subsequent offenses. 720 Ill. Compiled Stat. Ann. 5/14-4. Civil liability for actual and punitive damages is authorized as well. 720 Ill. Compiled Stat. Ann. 5/14-6.



    Federal law may apply when the conversation is between parties who are in different states, although it is unsettled whether a court will hold in a given case that federal law "pre-empts" state law, but either state may choose to enforce its own laws. Therefore it is better to err on the side of caution when recording an interstate telephone call.

    5 star could, in illinois, file a criminal and civil complaint against JJ. While it would not hold water in JJ's state he could be arrested and dragged back to Illinois to stand trial. Good job JJ way to think things through.

    JJ's defence, I taped the calls as evidence becuase I am getting threatening calls from this guy. Then JJ plays the tape where 5 Star threatens him. Case dismissed.

    I love the fact you took the time to look up and copy the Statute but missed the even more obvious threatening allegation.
