DULUTH, Minn. (AP) - The driver of a 1997 Honda Civic that struck and killed a dog near Cloquet is suing the dog's owners for damage done to his vehicle. Jeffery Ely was driving on the night of Jan. 4 when Fester, a miniature pinscher, squeezed past owner Nikki Munthe as she was letting in her other dog and ran out onto the road. Ely's car struck Fester, killing the 13-pound dog instantly.
Now Ely is suing the Munthes for about $1,100 for damage to his car, time he had to take off from his two jobs to get the car repaired, and court fees. Pieces of the bumper were propelled into the radiator when it hit the dog, Ely said, necessitating a replacement. Ely maintains he didn't have problems driving until after the accident and that the radiator issues were not pre-existing. Ely said he feels sorry for the Munthes' loss but, as a dog owner himself, feels that they must be responsible for their pets' actions. "I have complete compassion for them," Ely said. "I know how it feels. I love dogs. But once you get them, they are your responsibility." Munthe said she has always been worried about the busy road the family lives on. "We would have never let him off-leash because we're so terrified of this road," she said. The case will be heard in St. Louis County Court on Friday. The Munthes have filed a $2,400 countersuit against Ely for the cost to buy Fester, the time they had to take off work for court appearances, and the cost of buying a dog to replace Fester. ---------------- What a ****in stupid bastard this dude is |

Why shouldn't he ask for compensation to fix his car? The dog should've been on a leash or behind a fence. If the owner of the dog lets the dog run around where ever it wants then he puts himself in that position of responsibility.
I know she said she usaully has the dog on a leash, but that's just her trying to cover her ass. |

Finally,another poster from god knows where posts a story from my back yard.Yup,this one has made the news all over the country.I hate people that file frivalous lawsuits and I'm a huge dog-pet lover but I have mixed feelings on this one.I still haven't heard if the guy in any way was driving too fast.By that I mean alot of times if you are in a 30MPH zone and see kids or dogs,you certainly should slow down to a crawl.So if the guy was driving the limit after he saw a dog ahead of time,I blame the driver.If the dog just sped out in front of him where he had no time to react,the guy has a right to get compensated for his out of pocket expenses.I don't think anyone feels good about hitting a pet and killing it so I would be mad that I have to live with that fact too.
It all reminds me of George Castanza in a Seinfeld episode parking near a hospital.It was the pigman episode.Some mental patient jump from the top floor ontot he roof of George's car,gets killed and damages the hell out of George's car.Georger goes to the old battleaxe hospital administrator asking if he could file an insurance claim.She chews him out saying he's insensitive for thinking about money in a time of tragedy.Bull crap I say!!!! I know it was just a funny tv show but in all cases,even this one with the dog,alot of homeowners insurance policies may cover the drivers losses. |

I'm sure he is wanting payment for the damage to his bumper, time off from work, etc. etc. as well too. Yes, ppl are heartless with their lawsuits, my exgf sued me simply b/c I pushed her down a flight of stairs when she said she was pregnant. I mean hell is that my fault??? Practically an involuntary reaction to news like that, anyway she won and I had to pay for her wheelchair. Fukin courts are ridiculous these days, let ppl sue for anything!
