    Not sure what your point is, but drinkin and drivin is a very serious thing. . . Kills a ton of people every year. . .

    I got my DUI when I was 17 cost me 10,000. I learned my lesson. . .

    Unfortunately here ... u kill a person while driving drunk and the law will allow you to the leave the scene ... yes it does happen .. and YES IT IS FVKING STUPID!!

    Fact is, drinking and driving is not illegal. Anybody ever notice there are -- gasp -- parking spaces in front of, and to the side of, and many times in back of, almost every pub, bar and restaurant with drinking licenses in the United States of America?

    One of the first ?'s we ask juries during voir dire, actually ... if they are aware of this concept!

    But operating a vehicle with a blood alcohol level above a certain point is illegal. State legislatures have deemed it so and it appears in every code book multiple times.

    We should have patrol units outside of pubs/bars/etc ... and once they sit on the drivers seat ... bam! take the car away and throw that fvker in jail

    I'm in the done it and regret it department on this one. While I wasn't really bad in either situation there were 2 times that I could have waited another 30 minutes to an hour before getting behind the wheel. Fortunately nothing happened.

    The solution is harsher penalties.

    If you kill someone driving drunk i think your license should be suspended for life - and that means for all states, not just the state you are licensed in.

    Also, if you cause permanent bodily harm to a person your license should be suspended for at least 20 years.

    Lastly, the penalties for basic DUI offenses should be increased - however the legal limit on being drunk should also be increased so we are only penalizing people who are definitely too drunk to drive.

    You might have people complaining that the punishments are too harsh. If you can't take the punishment then don't drive drunk.

    Nina,

    You are correct and oversimplistic at the same time. In FL, they use the Intoxilyzer 8000 to test breath-alcohol. A perfectly functioning machine has a variance of .005 in either direction, meaning if a person blows .081 (.001 over the legal limit), that could actually be a .076 or a .086, or anything in between. Furthermore, testing is done between an hour and an hour-and-a-half after the person was actually driving, thereby not showing the person's BAC at the time they were driving. Finally, the longer you blow, the higher your "score" and there is nothing to monitor how long the breath techs have subjects blow for. Amazingly unscientific for something so allegedly precise.

    Any young lady on this site who has had two glasses of wine with dinner has probably flirted with, not only the waiter, but also the BAC limit if she drove. Is she a criminal? Check out your glass houses before you answer ...

    Which is why in cases of accidents, blood test are also required. It is standard for any defense attorney to request the calibration of the equipment used, the officers training on the equipment, and the percentage of error. Same with radar guns for speeding tickets.

    In the case of accidents, blood can be taken in FL, and that is only when there is injury involved (i.e. not a fender-bender) -- blood tests are MUCH more accurate than breath tests. Also, MUCH more expensive. Hence, why the state of FL rarely uses them!

    Once again, we don't have to request the percentage of error on each machine. It has already been established by expert testimony over and over again. The acceptable ranges of error are as follows.

    For .050 -- anywhere from .045 to .055 is acceptable
    For .080 -- from .075 to .085
    For .020 -- from .019 to .021

    Machines are tested every month at these three levels to make sure readings are coming in within these acceptable ranges by a maintenance tech ...

    As a matter of fact, a subject gives two breath samples. If one comes in at .081 and the second at .062, the machine is working properly, according to the experts, and a third sample IS NOT taken, as per FDLE regulations. There has to be a variance of .020 or higher between the first two tests in order for a breath tech to take a third and it is NOT UP TO HIS DISCRETION. That's just the way it is!

    Wonder how a jury knows which one is right? Wonder how anybody KNOWS, huh?

    It is the rainbow of knowledge. It prevents me from listening to falsehoods and half-truths without speaking/writing against them. And also causes me to tell the whole truth about certain other things, like the backwards nature of AL and her neighbors!

    But heck, I taught Roy Hibbert Jr., the center for the Georgetown Hoyas, in kindergarten (and he liked me as a teacher), so I guess I can't be ALL bad

    It takes about 3 DUI's within a certain number of years to evebn qualify for felony DUIs. A plain ol' DUI is a misdemeanor. The fine varies from city to city or county to county. My wee little town is also what is known as a "dry" county. There is no alcohol sold here. So not many people want to spend the money for an attorney when they can attend DUI Class and get a slap on the wrist.
