Question Landlord/tenant Dispute

BOYS I HAVE A SMALL PROBLEM WITH ONE OF MY TENANTS MAYBE YOU GUYS CAN HELP ME OUT.THE F-CKING KID IS A f\*g I JUST FOUND THIS OUT HELL I DONT CARE IF THE KID IS A f\*g I JUST WANT HIM TO KEEP THE NOISE DOWN.I GUESS HE TOOK OUT AN ADD ON CRAIGS LIST UNDER THE GAY SECTION I KNOW THIS BECAUSE I OVER HEARD HIM TALKING ON THE PHONE AND GUYS ARE COMING BY HIS APARTMENT ALL THE TIME.WHAT THE HOMO DOES ON HIS OWN TIME IS NONE OF MY BUSINESS HOWEVER I HAVE TWO OTHER TENANTS THAT ARE STARTING TO COMPLAIN ABOUT THE TRAFFIC COMING INTO THE BUILDING.

IMO I would tell the guy that you have noticed the traffic and you would like that to cut down a great deal... Don't mention the traffic being related to him being a homo (most would think it's drugs) just tell him to cut the traffic down... You can even make up some sh*t like "the local authorities" have been snoopin' around...

I can understand the tenants concerns. The volume of traffic is obviously noticeable.

When his lease is up.......don't renew it. Just ride it out until then. Notify the other tenants that he'll be gone when his time is up.

Or raise the rent by an unjustifiable amount.

BeanTown ... I rent some apts as well ... and I encountered a similar situation like yours in the past ... I simply came up to the kid requested to lower the traffic mainly due to other tenants worried about there own safety and that I wanted there request to be respected. I also did this in writing to protect myself.

He;s On What They Call A Tenacy At Will So All I Have To Do Is Give Him A Months Notice Then Go To Housing Court And I Could Lose This Case.if This Guy Wants To Stay Here In Massachusetts It Takes 3 Months Of No Rent To Get Him Out.i Would Have To Serve Him A 30 Day Notice Then You Wait 30 Days To See A Judge In Housing Court Then The Judge Will Say The Teneant Needs Some Time To Find Another Paartment By The Time Its Over I Am Out 4 Dimes And Then I Have An Empty Apartment.i Havent Met A Tenant Yet Who Paid Me While We Went To Housing Court.

I dont see that being difficult ... that is however in the form that you will request this ... buy the way you talk about the kid ... it seems that just by looking at him ... your gonna knock him out cold and not give a rats ass ... but then again you can have someone (other than JOHNNY KNOCKDOWN) to talk to the kid ... maybe your lawyer?

Your goal has to be to get rid of him. He is probably engaging in prostitution which is illegal. Talk to a lawyer. You have two options: start raising his rent until he leaves, or evict him. Do whatever you legally can when a tenant makes noises that disturb the other tenants. Most leases forbid tenants from making disturbing noises, if that be playing a stereo, or what this guy is doing. Almost all leases forbid tenants from using the premises for illegal activities. Your lawyer may tell you you have to warn him first before eviction, but you may be able to raise his rent based on the time you have to spend dealing with complaints. Depends on the laws in your state. Any future contact with this guy should be in writing. If you have to put a notice on his door, take a witness with you.

Again, your goal is that he leaves. You don't need his money when it limits your ability to get money from the other two tenants, who may already be looking for a new place to live. Even if the other two tenants stay, they are now less likely to accept rent increases over time, because the option of leaving has grown in attractiveness. Getting him to alter his behavior by having less guest over is useless. The other tenants will see that there are still guests, and be unhappy about it.

Why don't you confront some of the "visitors" and run them off for trespassing? The tenant cannot claim they are "friends" if they are coming in off a craig's list ad.

I woulnd't put up with this shit for five minutes.

Get him to straighten up with his visitors and kick his ass out. Your in America you have far more at to use than up here in Canada. What is happening is he is a male hooker which is ok but that is grounds to remove and evict him. Jimmy all you do is set up some camera in his place and watch the guys fuk each other for like 2 days and then show him the tapes and the craigslist add and he will leave voluntarily. Jimmy I know it will be painul seeing guys fuk and blow each other but it is the only way to approach this.

If what he is doing is illegal, he can be evicted and he stands no chance claiming civil rights. Just the ad itself, is probably enough evidence. This is not a case where a landlord must proove it beyond a reasonable doubt. This is not court.

Talk to a lawyer, and see if you can raise his rent to the point that he leaves. If you do decide to just warn him, or ask him a favor, send the warning in writing. Just telling him something orally, a friendly talk, is a waste of time. Don't assume he has "civil rights" he may in fact not have at all.

There is a lot more to being a good tenant than just paying the rent on time.

Another point, most leases/rental agreements forbid the use of the premises to run a business, or even act like you are running a business. "The apartment will be used for residential purposes only". Did this guy sign a rental agreement?

picoman, that's why he must talk to a lawyer now. He himself, could be investigated by the police, for being the owner of this brothel. It is imperative that he take action to make it clear, the landlord here is not involved in this apparent illegal activity.

I agree with Louis, mainly if one of the other tenants goes to the police and does a legal complaint and within it they note that the owner was informed and nothing was done. This can get pretty serious.

You can't legally evict him based on sexual orientation. Couldn't you tell he was a homosexual when you met him? If he is using the apartment as a brothel, then you can try to bust him. Sounds like you are stuck with him.
