Default Bet1128 being unfair to customers

Hello folks. I’ve been a long time lurker on SBR which has helped me avoid some of the more dubious bookmakers out there. However, I’ve recently been treated unfairly by Bet1128 and hope that someone here can help.

On Sunday the 5th of August I placed a bet with them on Lewis Hamilton to win the Hungarian Grand Prix. What later happened was Hamilton’s team mate Fernando Alonso, was moved back in the starting grid as a result of his behaviour in the qualifying stage. Alonso was moved back to sixth on the grid, while Hamilton therefore moved up to first. Hamilton then went on to win the race and here is where my problems began.

When I logged onto my account I saw that my bet on Hamilton had been voided by Bet1128. When I contacted them I was informed by their customer service manager that they were working on their communications systems so that customers could be informed of voided bets. Despite this, they were not willing to pay up on the bet.

Their customer service manager cited the following section from their rules:

“However, please note that point 18 of our T and C states: “All sporting events present on our website are subject to the rules of the relevant governing bodies which they strictly follow. However, if there are any authorized or unauthorized modifications to the rules or conditions of an event, 1128 reserves the right, in the interest of the client, to declare an event affected by these changes void.”

We take the decision to change the starting grid as an authorized modification and therefore we reserve the right to void the bet.”

My main problem with Bet1128 is the following:
1. Timing of decision:
My bet was cancelled at 9am on the day of the race, five hours before it started. This would have provided amble time to contact customers via email informing them of their decision. They failed to do so.

2. Behavior of Bet1128's competitors with regards to this bet:
Coral/Eurobet, Ladbrokes, Sporting odds, Interwetten, Bwin and Bet24 all paid out at odds equal or above to the 2.5 which I originally placed my bet at. They appear to have had no problem with the "Authorized modification" their customer service manager refers too.

3. "Authorized modification" of bet.
I feel that the language used in this sentence is highly ambiguous. Effectively, it means that Bet1128 could effectively void all bets if "conditions" changed. Does that mean that if it rained all bets are void? Also, does this also mean that Bet1128 voided ALL bets on this race, or just ones relating to Hamilton? Because, unless all bets were voided given the "authorized modification" they would be in conflict with their own terms and conditions.

I’ve tried without any success to get them to change their decision. I can also see that this is not the first time that they have voided a winning bet.

Can anyone on SPR help?

Sounds like the book might have a right to void that bet.....it's in the rules. The only thing I can compare that to.....is when you bet on a certain team in baseball and then there is a pitching change. At some of my books, they won't void it out and refund me until after the game. Sometimes it would be nice to get a heads up so you can re-bet....but it is how it is. Good luck man.

Cant think this is like a pitching change. Dont see that they should void this.
Almost anything could be voided if this rule is used.
Dont use 1128 and dont think I will

It depends, though. If they voided all bets, then that's acceptable. If they only voided the bets on Hamilton then that's not acceptable.
