Is the SBR points book an illegal sportsbook?
The points have a $ value and can be exchanged for cash. SBR is accepting bets and operating some of its operations from Texas.
What if they get shut down, will all points get paid out? Will crazylou have to go to jail?

The key point here is that SBR is not taking any cash from it's members. You could consider what SBR is doing as a promotional expense. Similar to a game show. People win money and that's not illegal. I see no illegality here whatsoever. Defense rests.

Technically it is because it is "Gambling". Points act as "CASH" tender when receiving "GIFTS".

Deuce, the key here is that nobody is putting up their own money. It eminates from SBR. Take the game show Jeopardy. Those contestants gamble every time they answer a question. There is no money being asked of the members and the points are a reward incentive. This is a promotion. If no money is being asked of the members, then no violation of any federal law has occurred. Defense rests, again. I would like to point out to the court that the defendants are being badgered.

It's not gambling when there isn't risk. ESPN and .net poker sites offer for-fun fantasy and pickems with prizes as well. On a side note, Picks and Points happens to be based in CR.

It's an interesting question... At first glance I thought "no way." But I am interested in looking at the case law (could be both a federal and state question). I'm sure SBR had an attorney look at it but these things are rarely so open and shut... That's why attorneys have jobs.

SBR points is a genius concept. Legally, it isn't gambling since players do not pay SBR for points.

They are not taking cash bets or are they paying out cash bets,if you redeem them for cash plays at the books,it's the books giving you the cash plays,not SBR.Case dismissed.

It's like rewards points for gasoline card. You get the option to get a gift card or cash back. Once the gas company gives you cash back if you decide to gamble with it the gas company is not liable for your gambling activities even though they sell the lottery tickets at the gas station.
