Default Anyone here ever beat a speeding by pace ticket? Any suggestions for court?

Court monday for my big dilemma, DUI/reckless driving by speed (speed obtained by pace), I know I was not going as fast as the officer claimed but around here the officers word is like a Bible scripture to these judges

The prosecutor will knock off the speeding most likely and you will have to deal with a DUI. It depends on the judge. Some judges hate DUI's, even first offenses, and they might suspend your license for a year.

If you plead not guilty, better hope the cop doesnt show up.. or hire a good lawyer. But i've seen many people hire shitty cheap lawyers who dont make a difference.

Well I live in VA and 1st offense DUI has an automatic 1 year suspension of license and up to a year in jail, the speeding was reckless driving the cop was a rookie and claimed he paced me doing 99 in a 55 which is absurd and not even close to accurate, Reckless driving in VA also carrys up to a year in jail and 6 month license suspension. Virginia has the toughest laws in the country for both DUI and Reckless driving. In my county the judges have a standard of 1 day in jail for every mile over 90, for my first offense dui I prob will not get any time but may, I'm planning for twoweeks in jail but think if I can disprove the reckless driving I may get off as far as jail time goes

The dui charge is the main one... I would say you will end up paying a ton of fines and be put under supervision for 6-12 months. Oh and the lawyer costs, ouch! Try not to drink, drive and speed... GL, and this will be costly...

And I think they test those radars for accuracy, or they cannot use...

In my county in VA if I'm convicted of the 99 in a 55 the standard is 9 days in jail, 1 for each mile over 90, the dui I prob will not get more than 5 days

What type of car do you drive? My best friend has been pulled over 3 times, due in large part to the fact that he drives a metallic blue mustang convertible. One cop even admitted to him that he pulled him over because he thought he would be some "punk kid", and was disappointed that he was a decent guy.

If you are driving a sporty car or a red car, you could argue to the judge that this may have given the illusion you were going faster.

DISCLAIMER: I am not a lawyer and I have no clue, just my opinion!

I would guess no jail time...you were obviously reckless... Be honest with yourself and the court, you are young you made a mistake. Ok, I will say obviously license suspended, large fines, supervision for a year, and if you are honest and accept what happened should cut your lawyer costs in half...

No radar, the speed would have to be an approximate. I would say yes I was speeding and I did not realize how fast I was going. When I was being stopped I did look at my speed at it was around 70mph. That way you are admitting fault, so you are not accusing the cop of lying, pleasing the judge with honesty (to a point), and not making anyone look bad....<<<<< Including yourself... Step up to the plate, take the blame and hopefully you can shorten a long drawn out case... GL

It is his word against the officer's, and I agree with you, he doesn't stand much of a chance. The fact that he got the DUI gives him even less credibility against the officer.

But any time you are fighting a speeding ticket, you are fighting the fact that the officer had a radar gun. But if he really believes that he wasn't going that fast and he wants to try and fight it, that was the best I could do.

EDIT: Caught by pace gives him an even better chance.

I'd make sure to be very apologetic about the DUI part and show the judge you are willing to take full responsibility for it. That might catch you a break on the speeding side... but again, this is just what I've heard from friends and what not, I'm no lawyer.

Well fighting a speeding ticket one thing...dui another(lawyer required to have courts respect)... and if it was paced it is an estimate, if radar and he does not know...worse. But either way he was speeding and needs to be honest. The dui is the thing here..

get a lawyer pal. worth it in the long run. The DUI is gonna screw you without a lawyer. You won't get shit knocked off, especially in VA.

it'll only cost you 10k if you're a rich dumb ass, throwing money around. You can get off of those charges knocked down for under 2k if you know someone.

Dui is worse on the record and I lose my license for longer, most people are downplaying the speeding because in most states it is not a big deal just huge fine but in VA you go to jail for anything over 90MPH if convicted, the DUI I only blew .13 so i won't have any mandatory jail time however the judge could do it at his discretion, my real goal here is to beat the Reckless so I won't have to do the 9days in jail as it could cost me my job, I will take the DUI and loss of license that means shit the killer will be having to take off two weeks of work and worrying my job may be filled when I returned all though I doubt this as my boss loves me

I am not a cop but I stayed at a Holiday Inn last night. On a serious note I did ask a friend who is a highway patrolman and he said you could go to his station and make sure his car in calibrated. The cars are supposed to be calibrated every so often and if it doesnt fall within that time frame then the speeding is thrown out. Obviously not the Deuce but maybe the speeding. Worth a shot.

I fought a speeding ticket one time... I asked about the officer's training with the lidar gun, and when the last calibration was...turns out the cop that bagged me was the instructor for using Lidar guns. oops.
