Well I know in MN it is a Felony. A lot of it depends on how much money is being transacted... if they did a sting (which is how you would most likely get caught) depending on the dollar figure it could be some serious time... not to mention tax troubles and several other charges that officials would try to nail you with...

I would say min.. 2-3 years

By the NYPC the relevant section is § 225 - Gambling Offenses, in pertinent part:

§ 225.20 - Possession of Gambling Records in the First Degree
A person is guilty of possession of gambling records in the first degree when, with knowledge of the contents thereof, he possesses any writing, paper, instrument or article:
1. Of a kind commonly used in the operation or promotion of a bookmaking scheme or enterprise, and constituting, reflecting or representing more than five bets totaling more than five thousand dollars; or
2. Of a kind commonly used n the operation or promotion of a bookmaking scheme or enterprise, and constituting, reflecting or representing more than five hundred plays or chances therein.

Possession of gambling records in the first degree is a class E felony

The relevant sentencing § is § 70.00 - Sentence of Imprisonment for Felony. It reads, in pertinent part:
§ 70.00(2)(e) - For class E felony, the term shall be fixed by the court, and shall not exceed four years.

Boner: Could they apply RICO to a one man shop? If you are an ongoing, criminal enterprise, (i.e bookie) doesnt that bring RICO into the mix? I know the FED's would have to get involved and everything which wouldnt happen for a small operation but just curious. Also, the use of a cell phone to conduct illegal activity is another charge that could be brought right?

Never knew a NY bookmaker that got caught the 1st time just for booking to get anything but a fine, the thing is they get some on racketeering charges which then is a different ball game.

I'm not sure about the ins and outs of RICO as I am not a criminal lawyer (I got a C+ in crim law) and don't have the statute here (to lazy to look it up on LexisNexis). As I understand it, in order to implicate RICO the bookmaking enterprise would have to rise to a certain level (as you noted). Also, the use of a cell phone might implicate some sort of fraud or interstate criminal activity but the state's case would be thin at best because of the mental state (of the criminal) required to prove a crime.

Again, to lazy (and unknowledgeable on this subject) to look up the true implications of these issues, you may be completely correct. Also, not getting paid for this research and it certainly doesn't qualify as pro bono...

Sure, what is chargeable if the DA wants to "go all the way" and what they eventually agree to is totally different. If the DA wanted to, they could charge a class E felony.

Thanks just curious... I knew a guy who got caught selling dime bags of weed and they tried to charge him with using a cell phone to promote illegal activity and the judge threw the charge out because it was definitely reaching... If you fly under the radar and arent running a million dollar a year operation, and do not threaten anyone to get your money I doubt anyone will mess with you.

Yeah, some of the criminal charges out there are just bunk, a good judge will do just what your buddies judge did, call it out.

And yeah, the statement of what the law is and what law is as enforced are two separate questions (as JJ pointed out).

It all depends on who makes the pinch, and where. Locals in Bk or the boogie down, not so bad. Mis-D and a fine. An OC task force much more of a problem. My first four were Mis-D's, and a fine. Five, and six were nightmares.
All in all, if you are clean, and stay SMALL, it is a good move. Take one pinch, and get out.
Do NOT shylock anybody, and stay away from scumbag New Jersey. Do not let anyone call you from that place, or they drag you over there to face charges. I swear they are more backward, and inbred, they those crackers from Mississippi.
