    On January 26th, I referred my case to Cyberluck (link), the licensing and hosting provider of Heroes Casino. Cyberluck, the Galewind software provider, and the Curacao Dept. of Justice are conducting the investigation. Cyberluck is a Master Licensing Authority member of the Curacao Internet Gaming Association (CIGA), a representative arm of the government of Netherlands Antilles.

    Members of the CIGA (link) and by extension their sub-licensees (Heroes Casino), are required to abide by CIGA's Code of Conduct:
    • 3. Financial: All CIGA members will ensure that there is adequate financing available to pay all current obligations and that working capital is adequate to finance ongoing operations. CIGA members will pay winnings and account balances promptly on demand.

    • 5. Dispute Resolution and Audit Trails: In order to provide prompt and efficient dispute resolution each CIGA member will retain detailed transaction records which will be archived, accessible and auditable by the Curacao Gaming Commission.

    • 6. Accountability: To enhance customer confidence in gaming system integrity, CIGA members making their service available in Curacao voluntarily agree to make their systems, algorithms and practices available for inspection and review by any legitimate gaming commission or governmental authority or to any independent testing authority recognized by the CIGA, in accordance with generally accepted methods for protecting proprietary information.

    Yes, hopefully you will.

    I think you would have gotten further by simple posting "STIFF" in all the forums, but maybe not.

    Obviously if they can't come up with a reason not to pay by now, they aren't going to. Well, they can probably make one up. This route lets them say "no comment, it is before the commission".

    I did this and have been reading for some time through all the posts on the multiple forums that the dialog was carried out on.

    I'm currently carrying out a poker bonus and reading through the posts really helped me to click the "fold" button more than I probably would have if I was just concentrating on playing poker.

    Anyway I had to ask .... Does your current situation stand at "I'm taking legal action and have been advised not to discuss anything about the case other than with your lawyer"?

    If not please do tell your current situation.

    Well, I guess all those posts are a fun read, huh? The dialogue moved between several forums and basically ended up on BlackjackInfo.com. Page 5 of this thread shows where Bruce offered to repay me but over a span of 18 months which was unacceptable. After the group that gave Bruce $100,000 decided not to join me and others in presenting our case to the district attorney of the city/county where Bruce lives, the district attorney did not put any effort into pursuing the case. It so happens that Bruce's wife works as a court reporter and works in the same building a floor above where the district attorney works so they actually know each other, in court and at the workplace. I did not and do not have the money to pursue this; it is enough that I related my experience with facts and people can take it for what it's worth. As for Bruce, I don't know why he is the way he is...I just hope he comes to terms with himself and what he did.

    I've sent an email to Cyberluck late Tuesday night (Feb. 17th) asking if the investigation is near completion yet. Once I hear from them I'll let everyone know.

    I never saw the original complaint. Did Heroes have anything solid suggesting the player cheated?

    My take on it is that Heroes are angling it to look like the Player was exploiting some non-random patterns in their software.

    First point: Most people familiar with online betting will tell you that the software is random and can't be exploited in that fashion.

    Second point: Even if he did find some non-random patterns and exploited them, so what? That's the casino's (and software provider's) problem ... pay the man his money.

    It does sound like this isn't true - ie the user found exploitable patterns. Of course, no way heroes can admit that, since it's essentially the same as admitting the casino is rigged.

    I signed up with Heroes through Peter's affiliate link. Peter has been/is working with me to resolve my case. Heroes said they would call him tonight but....

    After not getting any resolution from Cyberluck after seven weeks, I submitted my case to Casinomeister's Pitch-A-Bitch dispute resolution. End result: Galewind, Heroes casino software provider, examined my play at Heroes by using an independent consultant. They determined I did not use a robot or such software in my play. Heroes still believed I did and did not want to pay me. Galewind ended their association with Heroes and they agreed to pay me themselves. I received their check this week.

    Galewind Software, casino provider of Pinnacle Sports, have been nothing short of professional in dealing with the Heroes situation and took upon themselves the responsibility of resolving my dispute with Heroes.

    My "Final Report".

    I'd like to thank Bryan Bailey for his work on resolving my case. He did an excellent job and deserves that title "Casinomeister"!

    Thanks to Max Drayman too for support and work he did to backup Bryan. Online casinos wouldn't want to mess with that WILD BOAR!! [a reference to his avatar]

    Many thanks to GALEWIND SOFTWARE for stepping up to the plate and doing the right thing. They didn't have to pay me, since it wasn't their debt, but they are proud of their product and stand behind their product 100%, in the president's words.

    Also thanks to Peter Andrews of Online Blackjack Guide for his help behind the scenes. We uncovered that Cyberluck, the license grantor on behalf of the Government of Netherlands Antilles, was worthless in resolving casino/player issues. By the time I did the Pitch-A-Bitch, it was already SEVEN weeks since my case was "escalated" within Cyberluck.

    Also thanks to "Dirty" of Gambling IQ. He provided encouragement, understanding, and did some research that he may report on soon.

    Thanks to Eliot Jacobson for reporting on his company's testing of Galewind's software. Very interesting report. [on Casinomeister's forum]

    Lessons learned? I certainly would not go through this again:

    • I would not wait until my balance is over $30,000 to start a withdrawal
    • I would have all my documentation faxed, emailed, scanned, uploaded, updated, all taken care of asap
    • I would not bother with seeking dispute resolution with licensing authorities, unless they are in Gibraltar, Isle of Man, or Alderney
    • If the casino management speak in cryptic language or seem to stall for no reason, immediately start a dispute resolution process.
    In the end, did I find the Holy Grail of betting strategies? Unless Heroes lifts my suspension, I guess we will never know!
