I'm truly far more upset that California's Proposition 8 passed, amending the California State Constitution to expressly define marriage as between one man and one woman. People can elect whoever they want as President, but now we're using our governing documents to strip rights from people, and history has shown that to be a very destructive thing.

But when you open matters of discrimination to a plebiscite, the result is almost always more discrimination. If these types of restrictions were aimed against the majority, they would never make it on the ballot because even Americans aren't that stupid yet. The government is supposed to protect the weakest members of soceity, not assist the majority in subjugating them.

Actually I think it is more that people do not want the courts making law. The courts are there to interpret not legislate. The role of government is to protect all the people not one group.

Nah, although I respect your position, I think it's the ostrich in the sand effect. Every person I talked to when I was out urging people to vote No on 8 used the excuse that they didn't want gay marriage taught in school. They had no concept of the judicial aspect of gay marriage arriving in California this year. Most people aren't even smart enough to understand the concept of judicial activism, which renders them unable to be upset about it. They just wanted to be able to tell their kids that gay people are evil and headed to hell without the public schools contradicting that opinion.

And, interestingly enough, this was more an interpretation than an instance of creationism. Referencing the California Constitution as we found it yesterday:

ARTICLE 1 DECLARATION OF RIGHTS


SECTION 1. All people are by nature free and independent and have inalienable rights. Among these are enjoying and defending life and liberty, acquiring, possessing, and protecting property, and pursuing and obtaining safety, happiness, and privacy.


Now I think that most straight people would include finding a marriage partner as a very integral part of the pursuit of happiness. All the California Supreme Court was afford those protections to the obvious interests of the GLBT community. This Proposition is nothing more than legal sanction of public discrimination, which passed because it's much more acceptable to discard gays from society than entire races.

Sharky, these threads are much like conversations, in that the posted topic is simply the genesis of an exchange of thoughts and ideas which often quickly evolves away from the original debate. It was factually impossible to infer your intent from that single smiley. I'm sorry if you took offense, but had you thrown a sentence in with your smiley no misunderstanding would have been possible.
